City council asked staff to draft medical marijuana delivery ordinance

Medical marijuana would be delivered to the doorsteps of Longmont homes under a proposed ordinance that got the backing of the Longmont City Council Tuesday night.

Council members voted unanimously to direct city staff to prepare an ordinance for official review later this year. Delivery of medical marijuana became legal in Colorado on Jan. 1, 2020.

City Clerk Dawn Quintana told the city council that state rules for medical marijuana delivery “are robust and staff recommends keeping local code fairly simple for this reason.”

Quintana said the local delivery law would be crafted to keep hours of delivery consistent with the hours of operation of Longmont’s four marijuana dispensaries. The Longmont law would also prohibit the use of an off-premise storage facility to fill delivery orders and require delivery drivers to use body cams recordings, Quintana said.

The four city-licensed marijana dispensaries are: The Green Solution, 206 S. Main St.; Medicine Man Longmont, 500 E. Rogers Road; Terrapin Care Station, 650 20th Ave., and Twin Peaks Dispensary, 900 S. Hover St., Unit A.

Twin Peaks Dispensary is the only dispensary currently licensed for medical marijauana.

Quintana said the city shelved the idea of preparing an ordinance for the delivery of recreational marijuana, which becomes legal in Colorado on Jan. 1, 2021. The owners of two dispensaries who responded to a city survey on the issue, opposed recreational pot deliveries, Quintana said.

One dispensary owner said drivers delivering recreational pot would be more vulnerable to attacks, according to the survey. Medical pot deliveries are done by a professional service.

“This is really surprising to me,” said Councilwoman Polly Christensen. “I would think all the medical suppliers and stores would be really gung ho for this (delivery). But they brought forth a real detailed expression of the repercussions of delivery.”
