Public comment hearing for railroad rule amendments with PUC

A public comment hearing is scheduled for Thursday, June 1, 2023. The hearing is part of a rulemaking session in Proceeding No. 21R-0538R, regarding railroad rules, rail fixed guideways, transportation by rail, and rail crossings. The proposed rules seek to implement statutory fining authority.

Meeting Details

  • Proceeding No 21R-0538R, amendments to railroad rules, Thursday, June 1, from 11:30 a.m. until concluded or no later than 5:30 p.m., whichever is earlier.
  • Virtual meeting, via Zoom here. The link will take you to a registration page. Anyone wishing to provide public comment during the hearing must register with Zoom through this link. Once registered, Zoom will email registrants the Zoom information needed to join the hearing.

Rules regulating railroads in Colorado can be found in 4 Code of Colorado Regulations 723-7.

The hearing will address amendments to rules, including but not limited to:

  • Adding Rule 7001(h) “Imminent safety hazard” which means an imminent and unreasonable risk of death or severe personal injury.
  • Adding Rule 7001(i) “Alterations or “changes” or “modifications” at a public crossing include, but are not limited to, installing sidewalk panels, installing passive warning devices other than crossbucks and yield signs, installing active warning devices, changing crossing detection circuitry, interconnecting a crossing with a traffic signal or queue cutter signal, and adding or removing additional tracks.
  • Modifying Rule 7002(a) to: Commission action shall be sought regarding any of the following matters unless otherwise excepted by these rules through the filing of an appropriate application.
