Legislative Recap is an ongoing series of articles focused on actions in the Colorado Legislature that may be of interest to the people of Longmont.

In this inaugural issue of Legislative Recap, the focus will be on the bills that have been introduced by one of Longmont’s representatives in the Colorado Legislature. Depending on where you live in Longmont, we are represented in the House of Representatives by either Jonathon Singer (Democrat, District 11) or Mike Foote (Democrat, District 12). In the Senate, we are represented by Matt Jones (Democrat, District 17). Not all bills are listed, only those where the representative is the primary sponsor.

SB18-064: Require 100% Renewable Energy By 2035. The bill updates the renewable energy standard to require that all electric utilities, including cooperative electric associations and municipally owned utilities, derive their energy from 100% renewable sources by 2035. The bill will receive its first consideration in the Senate Agriculture, Natural Resources, & Energy committee on February 1st.

SB18-063: Oil Gas Higher Financial Assurance Reclamation Requirements. Mandates the Colorado Oil and Gas Commission insure that oil and gas permit applications include financial assurance sufficient to finance all reasonably foreseeable expenses related to ensuring compliance with the oil and gas law if the operator fails to meet its compliance obligations. Also adds requirements for permit applications in regards to reclamations based on hard rock mine reclamation requirements in existing law. The bill will receive its first consideration in the Senate Agriculture, Natural Resources, & Energy committee on February 1st.

SB18-048: Protect Act Local Government Authority Oil & Gas Facilities. See the January 14th article that discusses this act.

SB18-039: Continue The Wildfire Matters Review Committee. Defers repeal of the wildfire matters review committee from July 1, 2018 to September 1, 2025. The bill was reviewed by the Senate Agriculture, Natural Resources, & Energy committee on January 18th and voted 11-0 to be referred without amendments to the Committee on Appropriations.

HB18-1066: Clarify Sexually Exploitative Material Discovery. Clarifies that the sexual exploitation of a child statute does not change the discovery procedure for sexually exploitative materials and that defendant and defense counsel personnel are not allowed to receive copies of the materials. The bill will receive its first consideration by the House Judiciary Committee on January 30th.

HB18-1019: Kindergarten Through Twelfth Grade Accreditation Weighted Factors. The bill would require the state board of education to assign greater value to high school graduation rates that are based on more rigorous course work requirements, to compare school district performance based on school district size, and to assign greater value to schools that meet or exceed the minimum college admission course requirements. The bill was introduced at the start of the session, has been assigned to the Education Committee, with no hearing scheduled at this time.

HB18-1092: Marijuana Delivery Pilot Project. The bill would create a pilot program for delivery of medical and retail marijuana for 15 business in 3 municipalities. The bill will receive its first hearing in House Finance Committee on February 7th.

HB18-1050: Competency To Proceed Juvenile Justice System. The bill establishes a juvenile-specific definition of competent or incompetent to proceed in the juvenile justice system, as well as specific definitions for developmental disability, mental capacity, and mental disability when used in the context of assessing competence. The bill was introduced at the start of the session, has been assigned to the Judiciary Committee, with no hearing scheduled at this time.

HB18-1045: Dental Hygienist Apply Silver Diamine Fluoride. The bill would allow a dental hygienist to apply silver diamine fluoride under the direct or indirect supervision of a dentist if the dental hygienist meets certain requirements including specific training on applying silver diamine fluoride. The bill will receive its first hearing in the House Public Health Care & Human Services on February 6th.

HB18-1007: Substance Use Disorder Payment And Coverage. The bill includes multiple changes to state law to enable the expansion of health insurance coverage for substance use disorders. The bill was introduced at the start of the session, has been assigned to the Assigned to Public Health Care & Human Services Committee, with no hearing scheduled at this time.
